Terms & Conditions

Lucid Horizon LLC ("Lucid Horizon," "we," "our," or "us") provides premium real estate video production and related creative services. These Terms & Conditions ("Terms") govern all engagements, bookings, and communications between Lucid Horizon and any individual or entity ("Client," "you," or "your") who engages our services. By booking, contracting, or otherwise engaging Lucid Horizon, you acknowledge that you have read, understood, and agreed to these Terms in full.

1. Acceptance of Terms

By booking a shoot, submitting payment, signing an intake form, or otherwise engaging Lucid Horizon's services, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Lucid Horizon LLC. If you do not agree to these Terms, you must not engage our services.

These Terms supersede any and all prior verbal discussions, in-person conversations, informal agreements, or communications that conflict with the provisions herein. Any modification, addition, or exception to these Terms must be made in writing and mutually agreed upon by both parties.

2. Services Provided

Lucid Horizon provides real estate video production services, including but not limited to cinematic listing videos, drone aerial footage, twilight photography and videography, lifestyle content, retainer-based content production, and associated creative services. Specific deliverables, package inclusions, and pricing are defined at the time of booking.

3. Booking and Payment

3.1 Individual and Direct Agent Bookings. Payment is due in full on the same day as booking in order to reserve and lock in the shoot date. No shoot date is guaranteed until payment has been received and confirmed.

3.2 Corporate and Brokerage Billing. For Clients billed through an approved brokerage (including but not limited to Douglas Elliman, Corcoran, Compass, and similar corporate accounts), payment terms shall follow the brokerage's established Net payment schedule (e.g., Net 15, Net 30, Net 45), as agreed upon at the time of booking.

3.3 Late Payment. Invoices not paid by the stated due date shall accrue interest at a rate of one and one-half percent (1.5%) per month, or the maximum rate permitted by applicable law, whichever is lower. Lucid Horizon reserves the right to pause all ongoing and future work for the Client, across all active projects, until outstanding balances are paid in full.

3.4 Chargebacks and Disputes. In the event of a chargeback, payment dispute, or reversal initiated by the Client or the Client's financial institution, the Client shall be responsible for all associated fees, including bank fees, processing fees, collection costs, and reasonable attorneys' fees incurred by Lucid Horizon in recovering the disputed amount.

3.5 No Refunds. All payments are non-refundable once a shoot has been completed. No refunds shall be issued under any circumstances following the completion of a scheduled shoot, regardless of Client satisfaction, change of mind, or subsequent cancellation of the underlying listing. No refunds shall be issued regardless of whether the listing is withdrawn, sold, transferred to another agent, or otherwise cancelled prior to delivery of the final video.

4. Scope of Services

4.1 Single Filming Location. Unless otherwise explicitly agreed upon in writing prior to the shoot, each booking includes one (1) filming location. Additional locations, properties, or addresses are not included and must be quoted and agreed upon separately.

4.2 Shoot Duration. On-site shoot duration ranges from one (1) to four (4) hours, depending on the package selected by the Client.

4.3 Included Services. Services such as drone aerial footage and twilight photography are included within applicable package pricing where specified. Clients should refer to the package description provided at booking for inclusions.

4.4 Excluded Services. Lifestyle content is not included in standard packages and constitutes a separate, chargeable service. Lifestyle content includes, but is not limited to, footage of surrounding towns, neighborhoods, downtown areas, amenities, restaurants, beaches, parks, or any location beyond the primary filming address.

4.5 Travel, Parking, and Tolls. Standard travel, parking, and toll costs within Lucid Horizon's primary service area are included in package pricing. Service area includes the New York City metropolitan region, Westchester County, the Hamptons, Long Island, Fairfield County (Connecticut), and Northern New Jersey. Bookings outside this service area may be subject to additional travel fees, quoted in advance.

4.6 Weekend Shoots. Shoots scheduled on Saturdays or Sundays are subject to an additional weekend fee of two hundred fifty dollars ($250). The weekend fee shall be disclosed at the time of booking and added to the total shoot cost.

5. Written Communication Requirement

All scope, deliverables, add-ons, creative direction, revisions, and any modifications to the originally booked services must be confirmed in writing (via email or text message) in order to be binding and enforceable. Verbal conversations, in-person discussions, phone calls, voicemails, and assumptions do not constitute agreement or modification of scope.

If it is not in writing, it is not in scope. Lucid Horizon shall not be held responsible for any deliverable, inclusion, or expectation that was not explicitly agreed to in writing prior to the shoot.

6. Revisions

6.1 Minor Revisions Included. Each delivered video includes one (1) minor revision at no additional cost. A minor revision is defined as color adjustments, minor text or graphic changes, and minor shot selection modifications.

6.2 Revision Request Window. All revision requests must be submitted in writing within five (5) calendar days of initial delivery. After five (5) days, revision rights expire and the project is considered accepted and closed.

6.3 Major Revisions. Any revision request that constitutes a structural rebuild, full re-edit, alternate version, narrative restructure, or significant departure from the originally delivered cut shall be billed at a rate of two hundred dollars ($200) per hour, with a minimum charge of one (1) hour.

6.4 Client Change of Mind. Revision requests resulting from a change of Client preference, a change of listing agent preference, homeowner feedback, or any third-party request shall not be considered an error on the part of Lucid Horizon and shall be billed at the applicable major revision rate. Music change requests made after delivery shall be treated as major revisions and billed per Section 6.3.

6.5 Rush Delivery. Rush delivery within two (2) to three (3) business days, where available, is subject to an additional fee of two hundred fifty dollars ($250). Rush delivery must be requested and confirmed in writing at the time of booking.

7. Delivery

7.1 Standard Turnaround. Lucid Horizon targets a delivery timeline of five (5) business days from the date of the shoot. Turnaround may extend up to ten (10) business days depending on production volume, project scope, or other factors. Delivery timelines are estimates and are not guaranteed.

7.2 Delivery Method. All delivered files shall be provided via Dropbox or a comparable cloud-based file-sharing platform at Lucid Horizon's discretion.

7.3 Acceptance Window. The Client shall have five (5) calendar days from the date of delivery to flag any issues or request a minor revision. After five (5) days with no written feedback, the delivery shall be considered accepted and final, and no further changes shall be made.

7.4 File Retention and Download Window. The Client is responsible for downloading all delivered files within sixty (60) calendar days of delivery. After sixty (60) days, files may be removed from Lucid Horizon's cloud storage. Re-delivery requests after this period may be subject to an archive retrieval fee, or may not be fulfilled if files have been permanently removed.

8. Property Preparation

8.1 Shoot-Ready Standard. The property must be fully cleaned, staged, and shoot-ready upon Lucid Horizon's arrival. All interior and exterior lights must be turned on. Pets must be removed from the property during filming. Foot traffic during the shoot must be minimized.

8.2 Lucid Horizon Responsibilities. Lucid Horizon is not responsible for cleaning, organizing, staging, or preparing the property in any way. These are the sole responsibility of the Client, the listing agent, or the homeowner.

8.3 Not Shoot-Ready on Arrival. If the property is not shoot-ready upon arrival, a wait fee of two hundred dollars ($200) per hour shall apply, billed in hourly increments. If the property cannot be made shoot-ready within a reasonable time, the Client shall be responsible for rescheduling at full cost per Section 9.

8.4 Exclusive Property Access. Lucid Horizon requires exclusive access to the property during the scheduled shoot window. The presence of photographers, videographers, inspectors, contractors, stagers, or other vendors on-site during Lucid Horizon's scheduled shoot time disrupts production, compromises creative control, and causes scheduling delays. If Lucid Horizon arrives at a property and other vendors are present or scheduled to overlap with the shoot window, Lucid Horizon reserves the right, at its sole discretion, to (a) delay the shoot until exclusive access is granted, with any wait time billed at two hundred dollars ($200) per hour, or (b) reschedule the shoot, subject to a call-out fee of two hundred fifty dollars ($250) in addition to any applicable rescheduling fees under Section 9. Clients are responsible for coordinating vendor schedules to ensure exclusive access during Lucid Horizon's shoot window.

9. Cancellation and Rescheduling

9.1 All Bookings Final. All bookings are final. By booking a shoot, the Client reserves a specific date and time on Lucid Horizon's calendar, during which Lucid Horizon is unavailable to book other Clients.

9.2 Non-Refundable Fee. Cancellations, rescheduling requests, listing withdrawals, property sales prior to shoot, Client no-shows, or any other cancellation at any time after booking shall result in the full shoot fee being owed and is non-refundable, regardless of reason.

9.3 Rescheduling Fees. Reschedule requests made with more than forty-eight (48) hours of notice prior to the scheduled shoot may be accommodated at Lucid Horizon's discretion without additional fee. Reschedule requests made within forty-eight (48) hours of the scheduled shoot shall be subject to a fee of fifty percent (50%) of the original shoot fee. Reschedule requests made within twenty-four (24) hours of the scheduled shoot, or Client no-shows, shall be subject to a fee of one hundred percent (100%) of the original shoot fee.

9.4 Time is Lost. Time reserved on Lucid Horizon's calendar is time lost and cannot be recovered. This policy applies without exception, regardless of the reason for cancellation or reschedule.

9.5 Cancellation by Lucid Horizon. In the rare event that Lucid Horizon must cancel a scheduled shoot due to illness, emergency, equipment failure prior to arrival, or other circumstances, the shoot shall be rescheduled at no additional cost to the Client, with priority booking on the next mutually available date.

10. Weather and Reshoots

10.1 Weather Determinations. All weather-related shoot calls, including delays, reschedules, and reshoots, shall be made by Lucid Horizon at its sole discretion to ensure the Company's standards of quality and deliverable excellence are upheld.

10.2 Weather Reshoot Fee. In the event a shoot must be rescheduled or reshot due to weather conditions, a flat fee of two hundred fifty dollars ($250) shall apply. This fee reflects the operational cost of rescheduling crew, equipment, and travel, and is not a penalty. Weather is the fault of neither party; this fee ensures neither party bears the full financial burden of acts of nature.

10.3 Client-Caused Reshoot Fee. In the event a reshoot is required due to circumstances caused by the Client, the listing agent, the homeowner, or any party associated with the property — including but not limited to lights not being on, the property not being staged, homeowner interference during the shoot, pets on the property, or access being denied or delayed — a minimum reshoot fee of five hundred dollars ($500) shall apply.

10.4 Equipment Failure. In the event of equipment failure on the part of Lucid Horizon, including but not limited to camera malfunction, drone grounding, or FAA-related restrictions, Lucid Horizon shall reshoot the affected portions at its own expense. Lucid Horizon shall not be liable for any delay or indirect damages caused by such equipment failure.

11. Drone Services

11.1 FAA Compliance. All drone operations are subject to Federal Aviation Administration (FAA) regulations and applicable airspace authorizations. Lucid Horizon operates under all required licenses and certifications.

11.2 No Guarantee in Restricted Areas. Lucid Horizon cannot guarantee drone use in restricted airspace, controlled airspace requiring waivers, or areas where drone operation is otherwise prohibited by law or regulation. If drone footage cannot be captured due to regulatory restrictions, no refund or credit shall be issued.

12. Music Selection

12.1 Pre-Shoot Selection. Clients who have a preferred music track or stylistic direction must communicate this in writing prior to the shoot. Alternatively, Lucid Horizon may provide options for Client pre-approval.

12.2 Music Final at Delivery. Music selections are final upon delivery of the video. Any post-delivery music change request shall be treated as a major revision and billed per Section 6.3.

13. Licensing and Usage Rights

13.1 Limited License. Upon payment in full, the Client is granted a limited, non-exclusive, non-transferable license to use the delivered video(s) solely for the purpose of marketing the specific listing for which the video was created. This license extends to the booking agent and, where applicable, the agent's brokerage.

13.2 Prohibited Users. The license granted under Section 13.1 does not extend to, and the Client may not share the delivered video(s) with, any of the following parties without prior written authorization and a separate licensing agreement:

  • Builders, developers, and construction companies

  • Architects and interior designers

  • Homeowners and property sellers

  • Future listing agents (if the listing changes hands)

  • Any third party not expressly named in the original booking

13.3 License Non-Transferable. If the listing changes hands — whether due to expiration, withdrawal, agent change, brokerage change, or sale — the license granted herein does not transfer to any new listing agent, brokerage, or party.

13.4 No Editing or Repurposing. The delivered video(s) may not be edited, cut up, re-cut, combined with other footage, repurposed for other content, or otherwise modified by the Client or any third party. Such modifications violate Lucid Horizon's creative rights and the terms of this license.

13.5 Unauthorized Use. Any use of the delivered video(s) outside the scope of the license granted herein — including use by unauthorized third parties, unauthorized editing, or use beyond the original listing — shall constitute a breach of these Terms and a violation of Lucid Horizon's intellectual property rights.

13.6 Enforcement. In the event of a licensing violation, Lucid Horizon reserves the right to (a) revoke all usage rights granted herein; (b) issue takedown requests to MLS services, Zillow, Realtor.com, social media platforms, and any other distribution channel; (c) invoice a retroactive licensing fee equal to ten (10) times the original shoot cost, per unauthorized party, plus all enforcement costs; (d) pursue collection of unpaid licensing fees, damages, and associated costs; and (e) recover legal fees and collection costs from the Client.

14. Intellectual Property

14.1 Ownership of Raw Footage. All raw footage, unedited media, project files, and source materials remain the sole and exclusive property of Lucid Horizon LLC. The Client receives only the final delivered cut(s) as specified in the booking.

14.2 Raw Footage Not Included. Raw footage is not included in any package and is not for sale in the ordinary course of business. Raw footage licensing inquiries may be directed to Lucid Horizon in writing and, if accommodated, will be priced at Lucid Horizon's sole discretion.

14.3 Full Intellectual Property Retention. Lucid Horizon retains all intellectual property rights in the delivered work, including copyright, moral rights, and derivative rights. The Client's license under Section 13 does not constitute a transfer of intellectual property.

14.4 Portfolio and Marketing Rights. Lucid Horizon retains the perpetual, worldwide, royalty-free right to use any work produced under these Terms — including the delivered video(s), behind-the-scenes content, and any related media — in Lucid Horizon's portfolio, reels, social media, marketing materials, website, and any other promotional context, without further compensation or permission from the Client.

15. Homeowner Permissions

15.1 Agent Responsibility. The booking agent or Client is solely responsible for obtaining any and all necessary permissions from the property owner(s) to allow Lucid Horizon to enter, film, and produce video content at the property. By booking a shoot, the Client warrants that such permissions have been obtained.

15.2 No Liability for Homeowner Disputes. Lucid Horizon shall not be liable for any dispute, claim, or demand from a homeowner, occupant, neighbor, or other third party arising from the shoot, including but not limited to objections raised during or after the shoot or after delivery of the final video(s).

16. Authority to Approve Changes

Only the booking agent or designated Client contact may approve changes, revisions, or modifications to the scope or deliverables. Requests from assistants, transaction coordinators, brokers, homeowners, or other parties shall not be binding unless explicitly confirmed in writing by the booking agent or Client.

17. Indemnification

The Client agrees to indemnify, defend, and hold harmless Lucid Horizon LLC, its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Client's breach of these Terms; (b) the Client's use, misuse, or unauthorized distribution of the delivered video(s); (c) any dispute with the homeowner, brokerage, buyer, neighbor, or third party arising from the shoot or the delivered work; and (d) any negligent or wrongful act or omission of the Client or its agents.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Lucid Horizon's total aggregate liability arising out of or in connection with these Terms or any shoot shall not exceed the amount actually paid by the Client to Lucid Horizon for the specific shoot giving rise to the claim.

In no event shall Lucid Horizon be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost sales, lost listings, lost commissions, lost business opportunities, or loss of goodwill, regardless of the theory of liability and regardless of whether Lucid Horizon has been advised of the possibility of such damages.

19. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, severe weather events, pandemics, epidemics, public health emergencies, war, terrorism, civil unrest, government action, regulatory restrictions, utility or infrastructure failures, or other force majeure events. In the event of a force majeure occurrence, the affected party shall notify the other in writing as soon as reasonably practicable, and performance obligations shall be suspended for the duration of the event. Force majeure shall not excuse the Client's obligation to pay any amounts already owed to Lucid Horizon.

20. SMS Communications

20.1 Consent. By submitting your phone number through our website, contact forms, or booking platforms, you consent to receive recurring text messages from Lucid Horizon LLC relating to service updates, reminders, confirmations, promotional content, and project notifications. Consent to receive text messages is not a condition of purchase.

20.2 Message Frequency. Messages are sent periodically as needed. Frequency varies based on your interactions with us.

20.3 Opt-Out. You may opt out at any time by replying "STOP" to any text message. Upon receipt of your opt-out request, we will confirm your unsubscribe status and cease sending further messages unless you re-subscribe.

20.4 Help and Support. For assistance, reply "HELP" to any message or email us at frank@lucidhorizon.com.

20.5 Message and Data Rates. Standard message and data rates may apply. Contact your wireless carrier for details about your plan.

20.6 Carrier Disclaimer. Mobile carriers are not liable for delayed, undelivered, or misdirected messages.

20.7 User Responsibilities. By opting in, you confirm that the mobile number provided is your own and that you are authorized to receive text messages at that number. You agree not to use our SMS service for any unlawful or unauthorized purposes.

20.8 Data Handling. We collect your phone number and may store metadata related to message delivery and engagement for the purpose of managing and improving our messaging program. We do not sell or share your data with third parties for marketing purposes.

20.9 Third-Party Providers. Our SMS communications are facilitated through trusted third-party providers who process data on our behalf in compliance with applicable data protection laws.

20.10 Eligibility. You must be at least 18 years old, or have parental or guardian consent, to use our SMS services.

21. Privacy

Your privacy is important to us. Please review our Privacy Policy at https://www.lucidhorizon.com/privacy-policy for details on how your data is collected, used, and protected.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Westchester County, New York, and the parties hereby consent to the personal jurisdiction and venue of such courts.

23. Entire Agreement

These Terms constitute the entire agreement between the Client and Lucid Horizon LLC with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, understandings, negotiations, and communications, whether written or oral. No modification, amendment, or waiver of any provision of these Terms shall be effective unless made in writing and signed by both parties.

24. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

25. Waiver

No waiver by Lucid Horizon of any breach or default under these Terms shall constitute a waiver of any subsequent breach or default. No failure or delay by Lucid Horizon in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof.

26. Changes to These Terms

Lucid Horizon LLC reserves the right to update or modify these Terms at any time. Updates shall be reflected by a new "Last updated" date at the top of this page. Continued engagement of Lucid Horizon's services following any such update constitutes acceptance of the revised Terms.
